1 - Who is the Adjudicator in the general condition of contract of the civil works?
Answer: The ADJUDICATOR is the person appointed by the Contractor and employer to resolve disputes in the first instance in accordance to the General Condition of the Contract.
2 - What is Bill of Quantity?
Answer: It means the priced and completed Bill of Quantities forming part of the Bid.
3 - What is the Contract Price?
Answer: It is the price stated in the Letter of Acceptance and thereafter as adjusted in accordance with the provisions of the Contract.
4 - What is the intended completion date of the work?
Answer: It is the date on which it is intended that the Contractor shall complete the Works. The Intended Completion Date is specified in the Special Condition of the Contract.
5 - Who can amend the completion date of the work or issue order to speed up the work?
Answer: The Project Manager or as specified in Bidding Documents and/or Contract.
6 - What is the start date of the work?
Answer: The start date is given in the Special Condition of the Contract. It is the latest date when the Contractor shall commence execution of the Works.
7 - What is the defect liability period?
Answer: It is the period mentioned in the Special Condition of Contract and calculated from the Completion Date of the contract.
8 - Who is responsible for the safety of all the activities on the site?
Answer: The Contractor.
9 - If possession of a site is not given to the contractor by the date stated in the Special Condition of the Contract, who is responsible for the delay?
Answer: The Employer and this shall be a Compensated by him as per provision of Bidding Documents and/or Contract.
10 - Who is responsible for the quality control of the completed work?
Answer: Project Manager or as specified in Bidding Documents and/or Contract.
11 - Who is responsible to select the project manager and introduce him to the contractor?
Answer:Employer
12 - Who is responsible to hand over the site of the work to the contractor?
Answer:The Employer
13 - Is the approval of the proposal for speeding up the work to the contractor is the responsibility of the Employer?
Answer:Yes
14 - Who should possess the site and civil works after issuance of the work completion certification of the project manager?
Answer: The employer
15 - Is the employer responsible to answer the questions about the conditions of the contract?
Answer: The Project Manager is responsible or as specified in Bidding Documents and/or Contract.
16 - Who is responsible for the approval of the contractor’s key staff who are busy in the project?
Answer: The Project Manager or as specified in Bidding Documents and/or Contract.
17 - Is the decision made by the project manger in project issues represents the contractor or the employer?
Answer: Represents the Employer.
18 - Who is responsible for approval of work plan of the contractor?
Answer: The Project Manager or as specified in Bidding Documents and/or Contract.
19 - Who is responsible to control the contractor’s work and identify the defects?
Answer: The Project Manager or as specified in Bidding Documents and/or Contract.
20 - How many bids can a bidder submit?
Answer: Each Bidder shall submit only one Bid, either individually or as a partner in a Joint Venture. A Bidder who submits or participates in more than one Bid (other than as a subcontractor or in cases of alternatives that have been permitted or requested) shall cause all the proposals with the Bidder’s participation to be disqualified .
21 - Who is responsible for costs associated with preparation and submission of bids?
Answer: The Bidder shall bear all costs associated with the preparation and submission of his Bid, and the Employer shall in no case be responsible or liable for those costs.
22 - Whether the bid price includes all kinds of payable taxes?
Answer: All duties, taxes, including BRT and ST, and other levies payable by the Contractor under the Contract, or for any other cause, shall be included in the rates, prices, and total Bid price submitted by the Bidder or as specified in the bidding documents and/or Contract.
23 - What should the employer do if the contractor has not provided prices against the items stated in the bill of quantities?
Answer: The Bidder shall fill in rates and prices for all items of the Works described in the Bill of Quantities Items for which no rate or price is entered by the Bidder shall not be paid for by the employer when executed.
24 - What should be the exchange rate date to be used for the bid price?
Answer: 28 days prior to the deadline of the submission of the bids or as specified in the bidding documents and/or Contract.
25 - When can the bid security be forfeited or the bid-securing declaration executed?
Answer: In compliance with the bidding documents, a bid security is forfeited in the following circumstances:
  1. Modification or withdrawal of a bid after the deadline for submission of bids;
  2. Refusal by a bidder to accept a correction of an arithmetical error appearing on the face of the bid;
  3. Failure by the successful bidder to sign a procurement contract in accordance with the terms set forth in the bidding documents; or
  4. Failure by the successful bidder to provide the performance security as required by the bidding documents;
  5. Bogus information provided by the bidder about his/her eligibility.
